Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “Customer”) and Photobooth Decor, operating as ReviewWidget (“we,” “us,” or “our”). By creating an account, accessing the Dashboard, or embedding the Widget on your website, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree, do not use the Service.

2. Description of the Service

ReviewWidget provides a platform that:

• Connects to your Google Business Profile via OAuth 2.0 to sync reviews.
• Caches review data in our database so widgets load quickly.
• Generates an embeddable JavaScript widget that displays your reviews on any website you control.
• Provides a Dashboard to manage workspaces, widget settings, connected locations, and team members.

3. Accounts & Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for more than 12 consecutive months.

4. Acceptable Use

You agree not to:

• Use the Service to display fabricated, misleading, or manipulated reviews.
• Scrape, reproduce, or redistribute review data obtained through the Service for any purpose other than displaying it via the Widget on your own websites.
• Reverse-engineer, decompile, or attempt to extract the source code of the Widget or APIs (except to the extent permitted by applicable law).
• Interfere with or disrupt the Service, its servers, or connected networks.
• Use the Service in violation of any applicable law, regulation, or third-party rights.
• Attempt to bypass domain-restriction or authentication mechanisms.
• Resell or sublicense access to the Service without our prior written consent.

5. Google Business Profile Data

By connecting your Google Business Profile, you authorize us to access and cache your review data in accordance with these Terms and our Privacy Policy.

• You represent that you are authorized to connect the Google Business Profile(s) you link to your workspace.
• Reviews displayed through the Widget originate from Google and are subject to Google’s own terms. We display them as-is and do not edit review content.
• You may disconnect a Google connection at any time from the Dashboard. Doing so will stop new syncs; previously cached data will be deleted within 30 days or upon workspace deletion (whichever is sooner).
• You may also revoke access directly from your Google account permissions page.

6. Widget Embedding

• The Widget is provided as a JavaScript snippet that you embed on websites you own or control.
• You are responsible for ensuring that your use of the Widget complies with any privacy regulations applicable to your website (including displaying appropriate cookie/privacy notices to your visitors if required).
• The Widget loads review data from our servers. We make reasonable efforts to maintain uptime but do not guarantee uninterrupted availability (see Section 10).
• You may configure a domain allow-list to restrict where your Widget can be loaded. If no allow-list is configured, the Widget will respond to requests from any origin.

7. Intellectual Property

Our IP: The Service, including the Dashboard, Widget code, APIs, documentation, and branding, is owned by Photobooth Decor and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the term of your account.

Your content: You retain ownership of your workspace names, custom settings, and any content you provide. By using the Service, you grant us a license to host, cache, and display this content as necessary to provide the Service.

Review content: Reviews originate from Google and are subject to Google’s terms. Neither party claims ownership of third-party review content.

8. Payment & Pricing

The Service is currently offered free of charge during our beta period. We reserve the right to introduce paid plans in the future. If we do, we will provide at least 30 days’ notice before any charges apply. You will not be charged without explicitly opting into a paid plan.

9. Termination

• By you: You may delete your account at any time from the Dashboard. Deleting your account will permanently remove all workspaces, widgets, connections, and cached reviews.
• By us: We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Where practicable, we will provide advance notice and an opportunity to export your data.
• Effect of termination: Upon termination, your license to use the Service ends immediately. Sections 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), and 12 (Indemnification) survive termination.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) review data will always be accurate, complete, or up-to-date; or (c) defects will be corrected within any specific timeframe. Review content is provided by Google and third-party reviewers — we are not responsible for its accuracy.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall ReviewWidget, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your use of or inability to use the Service; (b) any unauthorized access to or alteration of your data; or (c) any third-party conduct on the Service.

Our total aggregate liability for all claims related to the Service shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) $100 CAD.

12. Indemnification

You agree to indemnify and hold harmless ReviewWidget and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights, including Google’s Terms of Service.

13. Third-Party Services

The Service integrates with third-party services, including Google APIs and hosting providers. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

14. Modifications to the Service & Terms

• Service changes: We may modify, update, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes.
• Terms changes: We may revise these Terms by posting the updated version on this page and updating the “Last updated” date. For material changes, we will provide at least 15 days’ notice via email or a Dashboard banner. Your continued use of the Service after changes take effect constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Montreal, Quebec, and you consent to the personal jurisdiction of such courts.

16. General Provisions

• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
